Stolen Cell Phone

My daughter's cell phone was stolen 3 weeks ago and I was able to recover it 2 weeks later. My dilema is that I was the one that got all of the information that was necessary to bring the phone home. I know people are probably saying "its just a phone you have it back forget about it. The point is that I spent hours with the young lady that took it a week prior to geting it back. I gave her countless chances to give it back and once she did I would leave and she would never see or hear from me again. At that point this girl blamed someone else so I then put that little girl through hell trying to get it out of her. She was truly scared. She too told me that the first little girl did have it. Which was my suspicion all along. At that point I told the police that if I do get the phone back and that girl has had it this whole time I want to follow through with charges.

Just as I suspected on 10/11/07 i received a phone call that the phone had fallen from this girls back pack at the bus stop and her little sister picked it up and ran it home to mom. The mother was going to bring it back but was unable to get to Elwood from Tipton. When I recevied the call I called the Tipton City Police and asked that they do a follow up on the phone based on the information that I was just given. Much to my surprise the officer called me back and he had my phone back!!! Was I shocked heck no I knew she had it. I told that officer at that time that I wanted to press charges because there is damage to the phone, afterall when she took it, it was only 3 weeks old. The phone is severly scratched and the camera lense is busted. I want her charged with theft and the phone replaced.

I made sure that the Elwood Police were notified that I had gotten it back. Let them to know that I wanted to file charges, I was told that once they got the report from Tipton that they would combine there information. That is really all I have heard about it. I want a new phone for my daughter and little thief charged, from what I am hearing about her this is not her first incident involving stealing from someone.

What more can I do to make sure that she is charged and we are reimbursed? Any thoughts or suggestions are welcome.

Hmmm, Small Claims

If your phone was damaged that would be a civil matter. Just take them to small claims court to seek damages. It cost about 40 bucks I think? But If you win that 40 will be added to the damages you seek! Hope this helps.

Then would I just take the police reports with me to file that? I have never done anything like that before. I would have thought that since the police recovered it from her for me that this would be part of the whole thing and there would be court and the judge would make the decision. Where do I go, to the Madison County Courthouse or would I go through Tipton County since that is where the phone was recovered at?

Tipton court would be the best bet

No you dont need a police report to file. Tipton court would be the best bet. When you get there they will give you a form to fill out and then they set a date for your hearing which at that time you can bring in your police report as part of your case.
